But i have one question, since it is GPLed, if I modify the theme to use a background from someone on deviantart, how do i handle the licence? Since your original is GPL (so my edited theme would have to be GPL too), but the background maybe not.

Well unless the Wallpaper is open for use, then including it would make it so you could not distribute the package.
